As you likely know, on-line poker rooms each have their rules governing the use of software while playing at their site. The only way to be certain of your standing within the rules, is to first inquire of the poker room regarding your proposed use of a specific software.
In the case of SharkScope, it appears that the rules of a few poker rooms have changed from permitted to prohibited. I inquired of SharkScope support regarding Full Tilt Poker, and you can read my request and their response below.
Notice, also shown below, that the SharkScope website mentions that PokerStars prohibits the use of SharkScope. The PokerStars Prohibited Poker Software page confirms that SharkScope is prohibited.
Of course, that presumably leaves several hundred other poker rooms where SharkScope is permitted while playing. And, as a tool for post-game analysis, there could not be any enforceable prohibitions by any poker room against SharkScope.

SharkScope Inquiry And Response:
Hi,
based on the Prohibited software page on the FullTilt website
SharkScope should not be prohibited. However FullTilt support have
recently started stating otherwise. Therefore if you have any
doubts/concerns you should email FullTilt themselves, but our software
will continue to work regardless.
